TAKTEEK DIGITAL MARKETING AGENCY
Digital Marketing & Advertising Policy
takteek.net — Digital Marketing Agency, Riyadh, Saudi Arabia
Takteek Digital Marketing Agency is a Saudi company specialising in growth and digital marketing, focused on creating value for its clients through digital marketing and social media, website development and technical support, and brand identity and design. Our vision is to transform budgets into strategic decisions that achieve desired results swiftly, while upholding the Islamic and cultural values of the Kingdom of Saudi Arabia. This policy aims to clarify the ethical and legal standards and controls that Takteek adheres to in delivering digital marketing services.
Objectives of the Digital Marketing Policy
- Protect the rights of clients and consumers by respecting privacy and complying with laws governing marketing and advertising.
- Ensure transparency and integrity in advertising content; all claims must be truthful, non-misleading, and evidenceable when necessary.
- Uphold the Islamic and cultural values of Saudi society and avoid any content that contradicts public morals or Islamic law (Shariah).
- Define the general terms of engagement with clients consistent with our results-driven strategy and partnership values, such as the requirement for an adequate advertising budget and a competent decision-maker.
- Protect personal data and comply with data protection laws, including Saudi Arabia’s Personal Data Protection Law (PDPL) and other applicable regulations.
Commitment to Islamic & Cultural Values
Takteek Agency is committed to respecting Islamic values and social norms in all advertising content and marketing activities. Accordingly:
- Advertisements must respect Islamic values and Saudi traditions, including avoiding any content that contradicts Shariah or promotes unethical behaviour.
- Advertising or marketing of Shariah-prohibited products or services is forbidden (such as alcohol, tobacco, gambling, or any other prohibited activity).
- Cultural sensitivities relating to identity and gender must be observed; advertising images and messages must be modest and respect social interaction norms in Saudi Arabia.
- Arabic is used as the primary language in campaigns targeting local audiences, with English permitted for international audiences; however, all legal statements and disclosures must be in Arabic.
Advertising Content — Commitment to Honesty & Integrity
- Takteek operates on the principle that advertising claims must be truthful, non-deceptive, and must not include misleading or unsubstantiated information. Any claims relating to products or services must be based on verifiable facts.
- We are committed to avoiding deceptive advertising practices such as misleading headlines or promises that cannot be fulfilled. Ethical guidelines confirm that misleading advertising undermines audience trust and may lead to legal consequences.
- All sponsored content or influencer endorsements must clearly disclose the commercial relationship; disclosures must be clear to indicate that the content is paid or sponsored.
- The use of manipulative techniques is prohibited, such as designs that force users to take a specific action or collect private information without their awareness. Ethical standards call for respecting audience autonomy and offering clear choices without coercion.
Our Commitment to Data Protection & Privacy
We are committed to protecting client and user data in accordance with Saudi Arabia’s Personal Data Protection Law (PDPL) and international standards such as the General Data Protection Regulation (GDPR) where applicable. Commitments include:
- Obtaining clear consent from individuals before using their personal data for marketing purposes; they must be able to opt out or withdraw consent at any time through a clear mechanism.
- Individual data may not be used in any advertising campaigns or marketing communications without documented explicit consent; implied acceptance is not considered legal consent.
- The sender’s name must be clearly displayed in every marketing message and identity must not be concealed.
- Providing a clear, easy-to-read privacy policy that includes the purpose of data collection and its legal basis, as well as individuals’ rights to access or delete their data.
- Ceasing marketing messages immediately and at no cost upon request by the individual.
- Maintaining records of when and how individual consents were obtained, and monitoring updates to relevant laws.
- Committing to notify the competent authorities and affected individuals in the event of a data breach or leak; Saudi legislation requires entities to notify authorities immediately and take necessary measures.
Project & Campaign Acceptance Conditions
Takteek is committed to establishing balanced relationships with its clients based on clear controls, as follows:
- Shariah & Legal Compliance: We will not accept any campaign or project that contains Shariah violations or contravenes Saudi regulations.
- Campaign Budget: The budget allocated for the advertising campaign must be SAR 10,000 or more to ensure the feasibility of implementing strategies and providing appropriate resources to achieve results.
- Decision-Maker Availability: A competent representative from the client’s side must be available who can make decisions promptly to ensure smooth workflow and effective results.
- Transparency in Objectives: The client must define clear and measurable objectives, as Takteek relies on a methodology where each step is linked to measurable results, which helps increase sales and analyse return on investment.
- Long-Term Partnership: Takteek sees itself as a strategic partner rather than merely a service provider; therefore, the client must have the intention to work long-term and provide the data necessary for measuring and improving performance.
Takteek’s Obligations to Clients
- Strategic Planning & Performance Analysis: We begin every project with a comprehensive analysis of data and previous performance to design an integrated strategy aligned with the nature of the client’s business and the Saudi market, linking each step to measurable objectives.
- Legal & Licensing Compliance: We ensure obtaining the necessary licences, such as the Motamad licence for promotional activities via social media when required; Saudi law requires individuals and institutions to obtain a licence from the General Authority for Audiovisual Media (GAVM) to conduct advertising through social media.
- Full Respect for Confidential Information: All information shared by the client with Takteek is considered confidential and used solely for project execution purposes. Data will not be sold or shared with any third party without written consent from the client.
- Transparent & Periodic Reporting: We will provide periodic reports detailing performance, return on investment, and actions taken, with a detailed explanation of decisions made and campaign progress.
- Continuous Improvement: We are committed to continuously improving campaigns based on performance data and market trends, while respecting ethical and legal values during testing and optimisation.
- Declining Unsuitable Projects: We will decline any project that does not align with our values, contradicts applicable regulations and laws, or lacks the required budget.
Client Responsibilities to Takteek Agency
- Providing Accurate Information: The client must provide us with all correct information relating to their products or services and rights to use trademarks and advertising materials.
- Obtaining Required Approvals: It is the client’s responsibility to obtain the required regulatory approvals and licences for their business activities; the client bears responsibility for any legal violation resulting from providing false information.
- Meeting Deadlines: The client must adhere to the specified deadlines for submitting materials and approvals required to ensure the project is implemented within the agreed timeline.
- Timely Payment: Takteek maintains clarity in billing policies, and the client must pay agreed amounts on the specified dates. In the event of late payment, the agency has the right to temporarily suspend services or terminate the contract.
Compliance with Local & International Laws
- Takteek’s activities are subject to Saudi laws and legislation governing advertising and marketing, including regulations issued by the General Authority for Audiovisual Media (GAVM/GCAM) which require obtaining licences and complying with content standards. The agency also complies with restrictions on content such as prohibiting the promotion of alcohol, gambling, or prohibited materials, and the requirement to respect religious and social customs.
- The agency complies with the Personal Data Protection Law (PDPL), which requires obtaining clear consent before using individuals’ data in marketing, and allows them to opt out easily. The agency also maintains a record of processing activities and respects individuals’ rights to access or delete their data.
- When dealing with audiences outside Saudi Arabia, Takteek complies with relevant international legislation such as the General Data Protection Regulation (GDPR) when targeting users in the European Union and other applicable privacy laws, and applies global best practices in data protection.
- We are committed to engaging influencers or client reviews in a transparent manner; regulatory bodies such as the US Federal Trade Commission (FTC) require influencers to make clear disclosures when a commercial relationship exists and that reviews are genuine and not fabricated.
Penalties & Liabilities
- Saudi authorities have the right to impose fines of up to SAR 5,000,000 on entities that violate advertising regulations or use personal data without authorisation. Potential penalties include suspending campaigns, removing violating content, and imposing additional penalties in cases of repeat violations.
- In cases of privacy data violations or cross-border transfers without authorisation, penalties may extend to imprisonment and substantial fines as stipulated by PDPL regulations.
